1. Acceptance of Terms

By accessing or using BarkPark Social ("the App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

2. Description of Service

BarkPark Social is a platform that helps dog owners find parks, track real-time park occupancy, connect with other dog owners, and share information about their dogs. The Service includes our mobile application, website, and related services.

You are responsible for obtaining Internet access and any equipment necessary to use the Service. You are also responsible for any third-party fees (such as data charges from your mobile provider).

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

4. User Conduct

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Post false, misleading, or inaccurate information about dogs, parks, or other users
• Upload or transmit viruses, malware, or other harmful code
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any commercial purpose without our prior written consent
• Scrape, harvest, or collect data from the Service using automated means
• Upload, post, or transmit unsolicited advertising, spam, or promotional materials
• Harass, stalk, or harm another user
• Post content depicting animal abuse or cruelty

5. User Content

"User Content" means any content you submit, post, or display on the Service, including text, photos, dog profiles, reviews, and comments.

Ownership

You retain ownership of your User Content. However, by posting User Content, you grant BarkPark Social a worldwide, non-exclusive, royalty-free license to use, copy, modify, display, and distribute your User Content in connection with operating and improving the Service.

Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:

• You own or have the necessary rights to post your User Content
• Your User Content does not violate the rights of any third party
• Your User Content complies with these Terms and all applicable laws

Content Moderation

We reserve the right, but have no obligation, to monitor, edit, or remove User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We may also suspend or terminate accounts that repeatedly violate these Terms.

6. Safety Disclaimer

IMPORTANT: BARKPARK SOCIAL IS NOT RESPONSIBLE FOR THE SAFETY OF YOU OR YOUR DOG.

You acknowledge and agree that:

• Visiting dog parks and interacting with other dogs involves inherent risks, including the risk of injury to you or your dog
• You assume all responsibility for your safety and the safety of your dog while using the Service or visiting any location discovered through the Service
• We do not guarantee the accuracy of park information, including hours, amenities, rules, or safety conditions
• Real-time occupancy data is user-reported and may not be accurate
• You should independently verify all park information before visiting
• We do not screen, verify, or endorse other users or their dogs

7. Premium Subscriptions

BarkPark Social offers premium subscription features ("BarkPark Top Dog"). By purchasing a subscription, you agree to the following:

• Subscriptions are billed on a recurring basis (monthly or annually) until cancelled
• You can cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• Refunds are handled according to Apple App Store or Google Play Store policies
• We reserve the right to change subscription pricing with notice to subscribers

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by BarkPark Social and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. You may not reverse engineer or attempt to extract the source code of the Service.

9. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by BarkPark Social. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARKPARK SOCIAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE SERVICE
• ANY INJURY TO YOU OR YOUR DOG WHILE USING INFORMATION FROM THE SERVICE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR PERSONAL INFORMATION

In no event shall our total liability exceed the amount you paid us, if any, in the six months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless BarkPark Social, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your access to or use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may delete your account at any time through the app settings. Upon termination, your right to use the Service will cease immediately.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, you agree to submit to the exclusive jurisdiction of the courts located in California.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BarkPark Social regarding the Service and supersede any prior agreements.
